Terms of Service

1. Who we are

FORTIFIZ is a service provided by [Titular: nombre o razón social] (tax ID [NIF/CIF]), registered at [Domicilio]. You can contact us at [email de contacto].

2. Purpose

These terms govern the use of FORTIFIZ, a web platform (installable on your phone) to plan training and nutrition, log results and manage the relationship between coaches and athletes.

To use FORTIFIZ you must accept them on your first visit, together with the Privacy Policy.

3. Account and access

You sign in with an account from an external identity provider; FORTIFIZ doesn't manage passwords. Access is by invitation from a coach or the FORTIFIZ team.

You must be at least 16, provide accurate information and not share your account. You're responsible for what's done with it.

4. Coaches and athletes

Coaches decide which workouts, diets and events they assign to their athletes and are responsible for their content and for them being suitable for each person.

When you accept a coach's invitation, they can see the workouts, results, diets, logged meals and measurements you record while your relationship is active.

If the relationship ends, or the coach deletes their account or their subscription ends, the athlete stops seeing the exercises, workouts and diets the coach created, keeps their history of results and continues using FORTIFIZ with a free account.

5. Not medical advice

FORTIFIZ's content doesn't replace the advice of a healthcare professional. See a doctor before starting an exercise or nutrition programme, especially if you have a health condition, and stop any exercise that causes pain or discomfort.

6. Acceptable use

You may not use FORTIFIZ for unlawful purposes, access other people's accounts or data, interfere with its operation, scrape data automatically or publish content that infringes third-party rights.

7. Intellectual property

FORTIFIZ, its software, design, brand and catalogue belong to [Titular: nombre o razón social].

The exercises, workouts, diets and dishes you create in FORTIFIZ, with their texts and with the images and videos that do not show people, remain yours and you can use them wherever you like. By creating them, you grant [Titular: nombre o razón social] a non-exclusive, free, worldwide, perpetual and irrevocable licence, with the right to sublicense it, to reproduce, distribute, publicly communicate and transform that content in any form and format, inside and outside FORTIFIZ: for example, to add it to the catalogue or to show it when promoting FORTIFIZ.

Images and videos showing people remain the property of their author, and each person keeps the rights to their own image. Over them you only grant us a non-exclusive, free licence to store and show them within FORTIFIZ while they are published; you can remove them at any time. By uploading them you confirm you have the consent of the people who appear in them.

You may only upload content over which you hold sufficient rights to grant these licences, and you are responsible for it not infringing third-party rights.

Your personal data (results, logged meals, measurements, notes) is not part of these licences: we process it under the Privacy Policy.

Part of the exercise and food catalogue comes from open projects under their own licences, listed in the Credits section.

8. Plans and payments

Paid subscriptions will be governed by the terms shown when you subscribe. Until they're available, using the service is free.

9. Suspension and closing your account

We may suspend or close accounts that breach these terms. You can stop using FORTIFIZ at any time and request deletion of your account by writing to [email de contacto]. If you are a coach, your athletes stop seeing what you created (section 4). Whatever we have already added to the catalogue under the licence of section 7 may remain in FORTIFIZ without data that identifies you; images and videos showing people are removed.

10. Liability

FORTIFIZ is provided as is. We take reasonable steps to keep it available and working correctly, but we don't guarantee it will be free of interruptions or errors.

We're not liable for damage arising from misuse of the service or from following training or nutrition plans without proper supervision. Nothing in these terms limits liability that can't be limited by law.

11. Changes

If we change these terms in a material way, we'll ask you to accept them again when you sign in. If you don't accept them, you won't be able to keep using FORTIFIZ.

12. Governing law

These terms are governed by Spanish law. If you're a consumer, you may go to the courts of your place of residence.
